Short-Term Vacation Rental

 

Beginning January 3, 2022, Collier County Ordinance No. 2021-45 requires property owners to register their short-term vacation rental. The intent is to collect current and accurate information regarding short-term vacation rental properties, encourage the appropriate management of these properties, and protect the general health, safety, and welfare of the residents and visitors to Collier County.

Properties located in the City of Naples, City of Marco Island, and Everglades City are exempt from Ordinance 2021-45. If you are unsure if the rental property is in unincorporated Collier County, please refer to the Trim Notices for the property which can be found on the Collier County Property Appraiser website. 

Short-Term Vacation Rental dwelling, means any habitable space, including a room, apartment, living quarters, in any residential building, including but not limited to condominiums, single-family or multi-family homes.

A Short-Term Vacation Rental dwelling that is rented for a term of 6 months or less is exercising a privilege which is subject to taxation as provided in F.S.§125.0104(3)(a), as amended. If a property owner rents, leases, or lets for consideration any living quarters or accommodations, who exclusively enters into a bona fide written agreement for continuous residence for longer than 6 months in duration, a tax will be levied in an amount equal to 6 percent of and on the total rental charged to the person collecting the rental fee according to the provisions of F.S. Ch. 212. Any property owner who does not meet the requirements to register with the Florida Department of Business and Professional Regulation (DBPR), as defined by F.S. Ch. 509.242, is exempt from this ordinance.

Per LDC section 5.03.03, guest houses may not be leased or rented.

Application Process

  • Obtain DBPR license. If it is a collective or group license, please include a list of all the properties along with the application.

  • Prior to commencing any short-term vacation rental, the owner must register with Collier County. 
  • Incomplete applications will not be accepted.
  • Apply online through the GMD Public Portal.

Owner Requirements

  • Property Owner must create a registered portal account with a username and password.
  • Inform all guests prior to occupancy of the rental unit of all applicable Collier County ordinances, including noise, parking, and garbage. 
  • Maintain rental units under their control in compliance with the occupancy limits, as specified in the Collier County Code of Ordinances, Collier County Land Development Code, Florida Building Code, and Florida Fire Prevention Code. 
  • Maintain rental units as specified in the Collier County Property Maintenance Code (Ordinance No. 2010-02, as amended).
  • Include the Collier County Rental Registration Number of the unit in all advertising of the availability of accommodations for the short-term vacation rental unit. Advertising includes, but is not limited to, print, radio, video, online, social media, and sharing economy platforms. 
  • Failure to complete registration of a short-term vacation rental property shall be punishable as provided by the Collier County Consolidated Code Enforcement Ordinance (Ordinance No. 2010-04, as amended) and shall be subject to a fine or civil citation up to $500 per violation per day for ongoing repeating violations.
  • The Property Owner must notify the County in writing of any changes in ownership or of the Designated Responsible Party within ten (10) business days of such change per the ordinance. The following completed forms must be uploaded to the open condition of the existing application through the GMD Public Portal for review and processing.
  • An updated Registration Application form must be completed that includes the new Designated Responsible Party Information along with the completed Affidavit of Authorization form. Short Term Vacation Rental Registration change of designated responsible party (non-refundable) - $50.00.

Designated Responsible Party

The designated responsible party contact needs to be available in person or by telephone twenty-four (24) hours a day, seven (7) days a week to address any law enforcement action, emergency response, or County ordinance violation arising from the rental unit and be willing and able to be onsite to address violations within the next day of notification.

This form is to be used to replace a Designated Responsible Party (‘Designated Responsible Party’) requesting to be removed from an application or issued Permit. For this process, there must be a Designated Responsible Party to replace the one identified on the Permit.
