Comprehensive Plan

The goal of the Growth Management Plan (GMP) is to establish the vision, framework and policies for future growth in Collier County, while maintaining compliance with the legislative requirements of the State of Florida.

The Growth Management Plan, and the Future Land Use Element and Future Land Use Element Map, may change by private petition, referred to as Growth Management Plan Amendments (GMPA), to modify a property's land use, density or intensity.

Capital Improvement Element

The Capital Improvement Element identifies public facilities that will be required to support the vision of The Collier County Growth Management Plan, including the cost of the facilities and sources of revenue that will be used to fund the facilities. This element relies upon the other elements of the Comprehensive Plan, such as the Conservation and Coastal Management Element, the Economic Element, Housing Element, Transportation Element, Recreation and open Space Element, and Public School Facilities Element to identify the capital improvements that are necessary to support the projected land use of the County. Conservation and Coastal Management Element

The Conservation and Coastal Management Element sets forth policies to provide guidance for the conservation, use, and protection of natural resources in the area; including air, water, water recharge areas, wetlands, water wells, estuarine marshes, soils, beaches, shores, flood plains, rivers, bays, lakes, harbors, forests, fisheries and wildlife, marine habitat, minerals, and other natural and environmental resources, as well as factors which effect energy conservation, as part of the Comprehensive Plan for Collier County. Economic Element

The Economic Element serves as a set of guidelines to assess the impacts of growth management decisions in the county's economic vitality, and encourages the County to consider economic matters in relation to its overall planning and growth management strategy, as reflected in the other elements of the Collier County Growth Management Plan. Future Land Use Element and Maps

The Future Land Use Element establishes the geographic framework for growth in Collier County and guides the county's land development regulations, private property rights, and decision-making by Collier County on regulatory, financial and programmatic matters pertaining to land use. It is central to the planning of protection and management of natural resources, public facilities, coastal and rural development, housing, community character and design. Housing Element

The Housing Element helps to create an adequate supply of decent, safe, sanitary, and affordable housing for all residents of the county. With the exception of housing opportunities provided to citizens of very modest means, the provision and maintenance of housing is traditionally a function of the private market. The development of private housing in Collier County is driven by an expensive housing stock; effectively excluding low-income and working class families from the housing market. Thus, there is a need for the county to find ways to encourage the provision of affordable-workforce housing for these families. Intergovernmental Coordination Element

The Intergovernmental Coordination Element formalizes coordination mechanisms and agreements between adjacent local governments, units of government, regional and state agencies through the coordination of planning strategies, municipal annexation plans, formal and informal coordination mechanisms. Policies pursued by the county may influence decisions or policies followed by municipalities within or adjacent to Collier County, adjacent counties, the District School Board of Collier County, service delivery agencies and the various independent special districts located within or adjacent to Collier County. Private Property Rights Element

The Private Property Rights Element serves to implement the legislative intent expressed in ss. 163.3161(10) and 187.101(3) that governmental entities respect judicially acknowledged and constitutionally protected private property rights. In considering whether to adopt changes or modifications to the GMP or the Land Development Code, the Board of County Commissioners must weigh the relative importance of many factors, including private property rights. Public Facilities Element

The Public Facilities Element of the Growth Management Plan addresses the provision of public facilities and services, including police, fire, human services, quality child care, schools and libraries, and a well maintained infrastructure. The policies in the Public Facilities element are intended to ensure that the community's public facilities continue to serve Collier County's needs now and in the future. The Public School Facilities Element establishes public school level of service standards and school concurrency management system to ensure adequate school capacity and the ability to accommodate enrollment demand as identified in the Capital Improvement Element plan. Transportation Element

The Transportation Element of Collier County's Growth Management Plan serves as the blueprint for the development of county's transportation system - including roads, transit, waterways, bicycle and pedestrian facilities. It identifies the types of policies and investments needed to ensure safe and efficient mobility for our residents, to support the county's economic vitality, and contribute to a high quality of life throughout the county over the next several decades. Rural Fringe Mixed-Use District

The Rural Fringe Mixed-Use District (RFMUD) is approximately 77,000 acres located east of Collier Boulevard. The original plan for this area was adopted in 2002. This plan is based on the principles of Transfer of Development Rights. Areas designated as "Sending" are areas of higher quality environmental habitat to direct growth away from. Areas designated as "Receiving" are areas where development is more suitable. The Transfer of Development Rights (TDR) is the mechanism that sends development rights in the form of TDR credits from the sending areas to the receiving areas. Land owners in the sending areas can voluntarily use the program to obtain and sell their TDR credits to developers in the receiving areas.

Collier County Transfer of Development Rights (TDR) Program

 The Collier County Transfer of Development Rights (TDR) Program includes Sending, Neutral and Receiving Lands in the Rural Fringe Mixed Use District. Sending Lands are those lands that have the highest degree of environmental value and sensitivity and generally include significant wetlands, uplands, and habitat for listed species. By selling their development rights, landowners may voluntarily achieve an economic return on their property while still being allowed certain limited permitted and conditional uses, as provided for in the Collier County Land Development Code (LDC) subsections 2.03.07 and 2.03.08.

This ordinance amends the Growth Management Plan to focus on the Rural Fringe Mixed Use District Restudy. The amendment requires the transfer of development rights for Comprehensive Plan amendments proposing to increase residential density in the Urban Mixed Use and Rural Fringe Mixed Use districts. The changes also remove density bonus caps for residential infill in the Urban Residential Fringe and the transfer of development rights requirement within one mile of the urban boundary.

Furthermore, it adjusts standards for affordable housing in the Rural Fringe Mixed Use District, introduces the Belle Meade Hydrologic Enhancement Overlay, corrects a scrivener's error in the Immokalee Road Rural Village Overlay, and mandates transmittal of amendments to the Florida Department of Commerce, specifying an effective date.

This ordinance amends the Collier County Land Development Code (LDC) to remove the $25,000 minimum value of the Transfer of Development Rights (TDR) base credit in the Rural Fringe Mixed Use District. Additionally, the ordinance includes amendments to Chapter 2 (Zoning Districts and Uses), specifically establishing procedures for severances and redemptions of TDR credits and the generation of TDR Bonus credit in LDC Section 2.03.07.D.4.f (Overlay Zoning Districts).

Rural Lands Stewardship Area Overlay Plan

The Rural Lands Stewardship Area (RLSA) program was established under the Future Land Use Element (FLUE) of the Growth Management Plan (GMP). Its objective is the creation of an incentive-based land use overlay system based on the principles of rural land stewardship found in Florida Statutes, Section 163.3248, including environmental preservation, agricultural preservation and smart growth development.

Through the RLSA program, Stewardship Sending Areas (SSAs) can be approved for preservation purposes, creating credits to entitle Stewardship Receiving Areas (SRAs), typically towns, villages, and compact rural developments (CRDs). The credit system is designed to incentivize preservation of the most import environmental lands, including large, connected wetland systems and significant habitat for listed species, by awarding higher credit values for high value preservation areas.

The Policies that implement this Goal and Objective are set forth below in groups relating to each aspect of the Goal. Group 1 policies describe the structure and organization of the Collier County Rural Lands Stewardship Area Overlay. Group 2 policies relate to agriculture, Group 3 policies relate to natural resource protection, and Group 4 policies relate to conversion of land to other uses and economic diversification. Group 5 are regulatory policies that ensure that land that is not voluntarily included in the Overlay by its owners shall nonetheless meet the minimum requirements of the Final Order pertaining to natural resource protection.
